OstoRecovery Terms and Conditions

These Terms and Conditions ("Terms") govern your use of OstoRecovery, including our website, registration forms, text-message education program, messaging services, and related features (collectively, the "Service").

OstoRecovery is provided by MeetAnOstoMate.org and operated by JDBS.

By accessing the website, registering for OstoRecovery, submitting information, or sending or receiving messages through the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What OstoRecovery Is

OstoRecovery is a 30-day text-message education program for people who have had ostomy surgery.

The Service provides short educational messages, practical guidance, reminders, approved resources, and replies to routine ostomy recovery questions when appropriate.

OstoRecovery is provided by MeetAnOstoMate.org. The Service is currently available at no cost to participants.

OstoRecovery is currently available by invitation only. If you are invited, you may receive a private registration link.

2. What OstoRecovery Is Not

OstoRecovery is not medical care.

OstoRecovery does not:

  • Diagnose medical conditions.
  • Treat medical conditions.
  • Monitor your health.
  • Provide emergency services.
  • Provide clinical care.
  • Replace your doctor, ostomy nurse, surgeon, medical team, emergency services, or other licensed healthcare professionals.
  • Provide individualized medical advice, treatment plans, prescriptions, medication instructions, or clinical decisions.

Always follow the instructions of your medical team. If you have urgent symptoms, call 911 or seek urgent care.

3. Emergency and Urgent Issues

Do not use OstoRecovery for emergencies or urgent medical needs.

OstoRecovery is not monitored in real time by clinicians. Automated responses may not be immediate, complete, or appropriate for urgent situations.

If you have severe, worsening, or urgent symptoms, call 911, contact emergency services, seek urgent care, or contact your medical team according to your situation.

4. Eligibility

You may use OstoRecovery only if:

  • You are invited or otherwise authorized to register.
  • You provide accurate registration information.
  • You provide a mobile phone number that you own or are authorized to use.
  • If you choose OstoRecovery text messages, you provide SMS consent and confirm enrollment by text if confirmation is required.
  • You are legally able to agree to these Terms.

If you register on behalf of someone else, you represent that you are authorized to do so and that the participant or their legally authorized representative has agreed to participate.

5. Registration and Invitation-Only Access

OstoRecovery is currently available by invitation only. The registration page may be private or accessible only to people who receive a registration link.

Submitting a registration form does not guarantee enrollment. We may review, reject, pause, deactivate, or delete registrations if needed for operational, safety, compliance, technical, or program reasons.

After registration, you may receive a text message asking you to confirm enrollment. You must reply YES or otherwise confirm as instructed before recurring program messages begin.

6. Text Messaging Terms

SMS consent is optional. Providing your mobile number or submitting the registration form does not, by itself, start recurring OstoRecovery text messages.

If you choose to provide SMS consent and later confirm by text, you agree to receive recurring text messages from OstoRecovery at the mobile number you provide.

Messages may include:

  • Enrollment confirmation messages.
  • Ostomy recovery education.
  • Practical guidance.
  • Reminders.
  • Replies to your messages.
  • Safety-related guidance.
  • Service updates.
  • HELP, STOP, START, pause, resume, or similar messaging-control confirmations.

Message frequency varies. During the 30-day program, you should generally expect about one scheduled education message per day, plus possible replies to your messages and service-related messages.

Message and data rates may apply. Your mobile carrier may charge you for messages or data according to your plan.

Consent to receive OstoRecovery text messages is not required to buy any product, request samples, receive medical care, use MeetAnOstoMate.org, submit the registration form, or receive unrelated services.

You can opt out at any time by replying STOP. After you opt out, you may receive one final confirmation message. You can request help by replying HELP or by contacting us through our Contact Us page.

Carriers are not liable for delayed or undelivered messages.

7. SMS Is Not Fully Secure

SMS is not a fully secure communication channel. Text messages may be visible to anyone with access to your phone, phone account, backups, notifications, carrier records, or connected devices.

You should not send information by text that you are not comfortable sending through SMS.

By using the Service, you understand that some messages may include ostomy recovery education, health-related context, or replies related to information you choose to send.

8. Participant Messages and Automated Replies

You may reply with routine ostomy recovery questions. When appropriate, OstoRecovery may respond with approved educational guidance.

Responses may be automated. Automated systems may use your registration information, prior messages, and program context to select or rephrase approved educational content.

OstoRecovery may not respond to every message. OstoRecovery may also provide safety-oriented guidance, such as recommending that you contact your medical team, ostomy nurse, urgent care, or emergency services.

You should not rely on OstoRecovery to detect, evaluate, or monitor medical problems.

9. Use of Automated Systems and AI

OstoRecovery may use automated systems, including artificial intelligence, to help operate the Service.

These systems may help classify messages, select approved educational content, maintain conversation context, identify possible safety-related concerns, and rephrase approved content into participant-facing responses.

Automated systems and AI are not medical professionals. They do not diagnose, treat, prescribe, monitor your health, or make medical decisions.

OstoRecovery is designed to use approved content, approved safety language, and system rules. Even so, automated systems can make errors. You are responsible for using your judgment and contacting qualified medical professionals when needed.

10. Educational Content

OstoRecovery educational content is general information. It may not apply to your specific medical situation.

Content may discuss ostomy recovery, adjustment, supplies, hydration awareness, skin care concepts, leakage, daily routines, product-related education, and other ostomy-related topics.

Educational content should not be used as a substitute for professional medical advice, diagnosis, treatment, or instructions from your medical team.

11. Product-Related Information

OstoRecovery may include product-related information, product categories, support resources, or service information when appropriate.

Product-related information may be based on approved manufacturer materials, support resources, or related educational content and may not be neutral across all manufacturers.

Product-related information is educational only. It is not a medical recommendation and should not replace guidance from your medical team, ostomy nurse, supplier, or other qualified professional.

12. Your Responsibilities

You agree to:

  • Provide accurate information.
  • Use only a mobile number you own or are authorized to use.
  • Keep your contact information current when possible.
  • Use the Service only for lawful purposes.
  • Not use the Service for emergencies or urgent medical needs.
  • Not misuse, disrupt, reverse engineer, attack, overload, or attempt unauthorized access to the Service.
  • Not submit false, abusive, unlawful, threatening, harassing, or harmful content.
  • Contact your medical team, urgent care, or emergency services when medically appropriate.

13. Privacy

Your use of the Service is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, store, and share information.

14. No Sale of Mobile Opt-In Data

We do not sell, rent, or share your mobile phone number, SMS opt-in data, or SMS consent information with third parties for their marketing or promotional purposes.

15. Program Changes, Pauses, and Termination

We may change, pause, limit, suspend, or end the Service at any time, with or without notice, for operational, safety, legal, compliance, technical, or business reasons.

We may pause or stop messages to you if you opt out, if your registration is incomplete, if your phone number is invalid, if messages fail, if the program ends, if we believe continued messaging may be inappropriate, or if required by law, carrier rules, or program rules.

16. Availability and Message Delivery

We do not guarantee that the Service will be uninterrupted, error-free, available at all times, or delivered without delay.

Message delivery may depend on mobile carriers, messaging providers, device settings, network availability, and other factors outside our control.

Carriers are not liable for delayed or undelivered messages.

17. Third-Party Services and Links

The Service may include links to third-party websites, resources, products, support services, or educational materials.

We are not responsible for third-party websites, content, products, services, privacy practices, or terms. You should review the terms and privacy policies of any third-party website or service you use.

18. Intellectual Property

The Service, including website text, program content, workflows, software, designs, logos, and related materials, is owned by JDBS or its licensors, except where otherwise stated.

You may use the Service for your personal, non-commercial participation in OstoRecovery. You may not copy, reproduce, distribute, sell, modify, or create derivative works from the Service without written permission, except as allowed by law.

19. Disclaimer of Warranties

The Service is provided "as is" and "as available."

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, completeness, reliability, availability, fitness for a particular purpose, merchantability, non-infringement, and suitability for your individual medical situation.

We do not warrant that the Service will meet your needs, prevent medical problems, detect urgent issues, improve recovery, or produce any specific outcome.

20. Limitation of Liability

To the fullest extent permitted by law, JDBS, OstoRecovery, MeetAnOstoMate.org, service providers, officers, employees, contractors, agents, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, loss of profits, service interruption, message delays, message failures, or reliance on educational content.

To the fullest extent permitted by law, our total liability for any claim related to the Service will not exceed the greater of the amount you paid to use the Service, if any, or 100 Canadian dollars.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, limitations apply only to the fullest extent permitted by law.

21. Indemnification

You agree to defend, indemnify, and hold harmless JDBS, OstoRecovery, MeetAnOstoMate.org, service providers, officers, employees, contractors, agents, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from or related to your misuse of the Service, your violation of these Terms, your violation of law, or information you provide.

22. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law rules, except where applicable law requires otherwise.

If you live outside Ontario, you may also have rights under laws that apply in your place of residence.

23. Dispute Resolution

Before bringing a formal claim, you agree to contact us and attempt to resolve the issue informally.

Any dispute that cannot be resolved informally will be handled in the courts located in Ontario, Canada, unless applicable law requires another forum.

24. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last Updated" date.

If changes are material, we may provide additional notice, such as through the website, email, or text message where appropriate.

Your continued use of the Service after updated Terms are posted means you accept the updated Terms.
